I hereby acknowledge that I have applied voluntarily to participate in activities or events which are sponsored, authorized, or run by NUBIAN SKI, hereinafter referred to as “NUBIAN SKI”. These activities and events may include but are not limited to the following: snow skiing, snowboarding, ski / snowboard training or instructions, ice-skating, sledding, parties, social events or functions, dinners, games, sports and recreational activities, raffles, fund raising activities, promotional activities, gatherings, dances, meetings, and any activities of any kind or manner which are sponsored, operated, managed or promoted by NUBIAN SKI.

 

  • I am aware that winter sports such as ice-skating, sledding, ski / snowboard instruction and ski / snowboard training, and skiing / snowboarding in general are hazardous activities and involve a great deal of risk of physical injury. I know that there are natural and man-made obstacles or hazards, surface and environmental conditions, and other risks which in combination with my actions or the actions of others can cause me very severe and/or even fatal injury and/or property damage. I understand that snow skiing / snowboarding and snow ski / snowboard racing are inherently dangerous activities and I voluntarily assume the risk of all course conditions and all risk of injury and/or death and/or property damage.

 

  • I am aware that at dances, parties, social functions, dinners, or any other activities sponsored, operated, managed or promoted by NUBIAN SKI, that alcohol may be served. I voluntarily release and waive any claims against NUBIAN SKI which can be attributed to serving, providing or allowing to be served alcoholic beverages at such functions. I further release NUBIAN SKI from liability for my actions or the actions of others attributed to the serving or providing of alcoholic beverages.

 

  • In lawful consideration of being permitted by NUBIAN SKI, its officers, employees, agents, sponsors, and volunteers to participate in snow skiing, snowboarding, ski / snowboard training or instruction, or any other activities, I hereby agree that I, my heirs, distributees, guardians, legal representatives and assigns will not make claim against, sue or attach the property of, or prosecute any Committee member, for injury or damage resulting from negligence of or other act howsoever caused as a result of my participation in any skiing / snowboarding activities or any other event sponsored by NUBIAN SKI . In addition, I hereby release and discharge the committee member from all actions, claims or demands that heirs, my distributees, guardians, legal representatives, assigns or I may now have or hereafter have for injury or damage or even death resulting from my participation in any activity or event sponsored in whole or in part by NUBIAN SKI. I also waive and release any claim that I may have against the NUBIAN SKI from any claim based upon negligence or breach of warranty. I agree to indemnify each committee member for all claims brought by a third party, which I may cause.

 

  • I expressly agree that the foregoing release, waiver and indemnity agreement is intended to be as broad and as inclusive as is permitted by the law and that if any of it is held invalid, it is agreed that the balance shall notwithstanding continue in full legal force and effect.

 

  • I hereby acknowledge that my membership in NUBIAN SKI and /or participation in any of its activities or events does not in any way include or guarantee to me any insurance coverage of any kind. I have carefully read this agreement and fully understand its contents. I am aware that it is a release of liability and a contract between myself and NUBIAN SKI and I have signed it voluntarily and of my own free will. I also verify that if I have signed without release of parent or guardian, that I am at least 18 years old and of lawful age in which to legally sign this contract.

 

TERMS OF USE & CONDITIONS

Holidays booked through Born2ski Ltd are governed by Born2ski Ltd terms and conditions.

 

1. Booking conditions:

 

Your legal contract is with the tour operator (or airline) specified on your confirmation receipt. Born2ski Ltd. It is essential that you have read and understand their booking conditions. As Outlined here. All timings are provisional and are subject to change under your tour operator’s terms and conditions.

 

Any complaints regarding your holiday must be received in writing within 28 days from the date of return. It is strongly recommended that you communicate any complaint to the tour operator without delay. Special requests will be notified to the tour operator but under your tour operators booking conditions cannot be guaranteed. If you wish to make any changes to your holiday, we will do our utmost to make these changes but it may not always be possible.

 

Any changes or cancellations must be received in writing (Email) from the person group organiser who made the booking. Any amendment or cancellation will result in charges.

 

All Contracts will be concluded in English. The lead named passenger NUBIAN GROUP is responsible for ensuring the total balance is paid. We act as agents for ATOL holders and other principles.

 

2. Deposits & balance payments:

 

If your holiday is booked inside 12 weeks of departure, the full cost of your holiday is due. Outside of 12 weeks a NON REFUNDABLE deposit plus insurance premium

(If applicable) must be paid.

 

Please note that Born2ski Ltd will not send you a reminder when your balance is due. If full payment is not received by the balance due date, we will notify the principal who may cancel your booking and charge the cancellation fees set out in their Terms and Conditions.

 

There may be some instances where we are not able to confirm some of our arrangements straight away (such as flights or some ground arrangements) in which case this will be indicated on your invoice.

 

A contract for these arrangements will only be made when we have confirmed them in writing, usually by means of an additional invoice. Errors in costings are very rare, however, if there is an obvious error on your invoice we reserve the right to correct this as soon as we are aware of it. If you wish clarification of information or to include things in your contract, please request these in writing and we will confirm our acceptance in a written confirmation.

 

You must provide us with all the names (and ages of children if your party includes children) of the people in your party no less than 14 weeks before departure if you are using our charter transport services.

 

If you are travelling on any other type of transport including scheduled flights, names as they appear on passports must be supplied at the time of booking.

 

** These must be correct as changes to scheduled flights (including spellings of names, as well as times) will incur a 100% cancellation charge by the airline.

Please be aware that any monies paid in order to go ahead with a request for flights or accommodation constitutes a commitment to proceed with the booking if your request can be fulfilled. Such monies are non-refundable unless the request cannot be fulfilled.

 

3. Paying for your holiday:

 

You will be required to pay a deposit per person to secure your holiday unless you book within 12 weeks of departure in which case full payment is required. The amount of the deposit will be specified at the time of booking and will vary according to your holiday arrangements. This is because some suppliers including airlines require full payment at the time of booking. In this case these amounts are non-refundable and this can be as much as 100% of the holiday.

 

4. Costs:

 

The government replaced Air Passenger Duty paid by all passengers on flights leaving the UK with an emissions tax from 1st November 2009.

 

Prices for your Group have been calculated on current costs for this tax. We reserve the right to amend our prices to reflect changes in costs announced by the government.

 

Once the price of your chosen holiday has been confirmed, then, subject to the correction of omissions or errors, we will only increase the price in the following circumstances:

 

  • Changes in transportation costs, including the cost of fuel, dues.

 

  • Airline taxes or fees chargeable for services such as landing taxes or embarkation or disembarkation fees at ports and airports.

 

  • Exchange rates mean that the price of your travel arrangements may change after you have booked.

 

5. Events beyond our control:

 

Force Majeure: This means that we will not pay compensation if we have to cancel or change your travel arrangements in any way because of unusual or unforeseeable circumstances beyond our control. These can include, for example, war, riot, industrial dispute, terrorist activity and its consequences, natural disasters (such as avalanches), nuclear disaster, fire, adverse weather conditions, epidemics, technical problems with accommodation or transport, closure or congestion at airports, stations or ports, cancellations or changes of schedule by carriers or alteration of aircraft type by suppliers, or suppliers ceasing to operate due to adverse weather conditions and all similar events outside our or their control or any similar events.

 

6. Cancellations and Amendments by you:

 

If you wish to change any details of your booking we will do our best to help. However, in the case of major changes (such as those that will lower the basic price of your holiday or that would cause your holiday to cease being a package holiday) will be treated by us as a different holiday and cancellation charges apply.

Changes to your accommodation and flight within 85 days prior to departure will also be treated by us as a different holiday and will also incur cancellation charges. If we are able to change your holiday details without cancellation (i.e. without it constituting a different holiday as defined above) we will make an amendment charge of £50 per change per person if more than 85 days before departure. Within 70 days of departure the fee will be £75 per change per person.

 

The price of your new travel arrangements may not be the same as when you originally booked. The new price will be that which applies on the day you asked for the change.

 

If you wish to make a change to your holiday whilst in resort (i.e. extending or reducing your holiday or changing accommodation) this will be subject to availability. Any such changes must be advised to us in writing either via our head office in Leeds. Any additional costs including administration fees must be paid locally.

 

Most scheduled carriers prohibit changes (including name changes and times) and require that new tickets be purchased or charge a high amendment fee. These charges will be passed on to you. Once tickets (including e-tickets) have been issued and sometimes even before they have been issued, any changes at all to the ticket (including initials) will result in you having to pay for the cancelled ticket and buy a new ticket at the full cost. Therefore it is important that you take great care when providing names and departure details. If your change means that we have to send you, new tickets, we cannot do so until we have received all your travel documents including your tickets.

 

Cancellations must be confirmed in writing (email) by Nubian Group organisers who made the booking. We cannot accept verbal cancellations. Once you have cancelled your booking we will send you a cancellation invoice (usually by email). If you have not received this within 14 days please contact us. To cover the cost of processing your cancellation, the cancellation charges below are payable (including extras) from the date we receive written confirmation. The more notice you give us, the less we charge. The person who made the booking is responsible for this charge.

 

*** Please remember that The Group USA & Canada holiday arrangements (Are operated by scheduled carriers). These cancellation charges may be higher than those shown. In these cases 100% cancellation fee applies as soon as the Final booking (With Client Names **) is made with the Airline and the ticket issued. In these instances the charges below are as a % of the cost of all the remaining arrangements and the non-refundable charges will be added to these.

 

The number of days prior to departure is taken to be from the day on which written (emailed) notice is received by us: cancellation 84 days or more prior to departure = loss of deposit. See ***

 

USA, Canada, Japan.

70 -83 days = 45%

0-69 days = 100%

 

7. Insurance - IMPORTANT

 

It is an express condition of booking that you have adequate travel insurance offering cover for (but not limited to) delayed departure (outbound and inbound), too much snow as well as too little, resort closure due to force majeure and hired equipment.

 

You must ensure that your insurance covers you for all the activities you undertake in resort such as après-ski or heli-skiing and that your policy covers you for hired equipment if this is what you chose to do. No liability will be accepted by Born2ski Ltd for any clients travelling without adequate insurance.

 

It is important that you travel with adequate travel insurance for all members in your party. If you have declined our insurance we accept no liability for any costs incurred prior to travel or during your holiday, which arise from failure to obtain adequate cover.

 

8. Passport:

 

If you wish to travel abroad you must hold a ten-year passport, even for a day trip.

Apply in good time to the UK passport office 08705210410. For non-UK residents you should contact your consulate or embassy. Ensure your passport is valid for the duration of your trip.

 

Some countries have an immigration requirement for a passport to remain valid for a minimum period (usually six months) beyond date of entry to the country. This is a requirement of the country concerned, not the UK passport office. Any questions should be addressed to the relevant consulate or embassy.

 

9. Visa requirements:

 

You may require a visa to enter the country you are travelling to. For Journeys to the USA & Canada you will require ESTA Pre Booked Entry Visas.

 

For all visa enquires contact the consulate or embassy of the country you plan to visit. If you are a British Dependant Territories citizen, British overseas citizen, British subject, British National overseas, or a British protected person, you may need a visa that is not required by British citizens.

 

10. Flight times and changes:

 

All flight timings are provisional and could be subject to change. You'll be informed of any major changes to your flight or other part of your holiday.

 

11. Other service charges

 

Born2ski Ltd will make the following charges: in addition to any AIRLINE or Supplier charges:

 

  • Amendment: £20 per-person for booking amendments

  • Cancellation: £40 per-person except where the cancellation charge is 100%, when no charge.

 

12. Your money is financially protected:

 

We are deal with fully bonded members of the Association of British Travel Agents (ABTA). In the unlikely event of your ATOL protected operator's insolvency, your money is protected under the terms of this licence.

 

13. Property descriptions:

 

We believe that our property descriptions are accurate and complete, however, tour operators provide this information to us either electronically or we take it from their brochures. Although we make every effort to keep up to date with any alterations, we do not accept any liability arising from any inaccuracy or omission in the property descriptions.

 

All bookings are handled by Born2ski Ltd (ABTA No P6811) who are retail agents for ATOL holders. All holidays listed on this website are subject to availability at the time of booking.

14. Data Protection Policy

 

Your booking: In order to process your booking and to ensure that your travel arrangements run smoothly and meet your requirements we need to use the information you provide such as name, address, any special needs/dietary requirements etc. We take full responsibility for ensuring that proper security measures are in place to protect your information. We must pass the information on to the relevant suppliers of your travel arrangements such as your tour operator, airlines, hotels, transport companies etc.

 

The information may also be provided to public authorities such as customs/immigration if required by them, or as required by law.

 

Additionally, where your holiday is outside the European Economic Area (EEA), controls on data protection in your destination may not be as strong as the legal requirements in this country. We will not however, pass any information onto any person not responsible for part of your travel arrangements. This applies to any sensitive information that you give to us such as details of any disabilities, or dietary/religious requirements. (If we cannot pass this information to the relevant suppliers, whether in the EEA or not, we cannot provide your booking. In making this booking, you consent to this information being passed on to the relevant persons.)

 

Usually your tour operator or other principal will pass this information onto their suppliers once we have provided it to them. The tour operator or other principal's use of your information is subject to their policy, both in respect of your booking and any future marketing, and is their responsibility. Please ask either us or them for a copy of this if you would like to see it.
